NAIROBI, Kenya (AP) - A magistrate in Kenya has sentenced an American who founded a popular chain of coffee shops to 15 years' imprisonment for the statutory rape of three teenage Kenyan girls.

Principal Magistrate Teresia Ngugi says Jon Cardon Wagner paid two women $500 to bring the 13-year-old and two 14-year-olds to his house. A Nairobi court convicted and sentenced him on Friday.

Ngugi says his alibi was weak because it relied on the word of his friends.

Wagner's lawyer Mohammed Nyaoga says his client is the victim of an extortion racket and will appeal.'

Nairobi Java House began a culture of gourmet coffee drinking nine years ago and now has eight coffee shops in the capital. It is popular with wealthy Kenyans and expatriates. The chain also exports Kenyan coffee to America and Europe.

KAMPALA, Uganda (AP) - A traditional Ugandan ruler canceled a planned rally Saturday following two days of deadly riots between his supporters and security forces, as the capital returned to a wary calm.

People were moving around on the streets Saturday under the eyes of patrolling police. The unrest has underlined growing tensions in a nation hailed for its relative stability and economic growth.

Thirteen people were killed after the government prevented a representative of the King of Buganda from traveling to a region near the capital on Thursday on "security grounds."

Buganda King Ronald Muwenda Mutebi II canceled his Saturday appearance in Kayunga, where the kingdom claims land as part of its historical territory, because of the potential for more violence, his spokesman said.

The violence stems from disputes between the government and members of the Buganda, one of Uganda's four ancient kingdoms. Members of the Buganda ethnic group have clashed previously with the government over land.

"Our king must be free to go where he wants," said Stephen Semagula, 18, a student in Kampala. "It's our land."

Uganda's traditional kingdoms were banned in 1966 but reinstated by President Yoweri Museveni in 1993. But Museveni has restricted their leaders to a largely ceremonial role to avoid potential political rivals.

Members of the kingdom make up Uganda's largest ethnic group and there is friction between the Buganda and members of the smaller Banyara tribe, who claim the Buganda refuse to recognize them.

IAAF urges caution over Semenya intersex claims

(CNN) -- The international governing body for athletics urged caution Friday after reports that the world-champion South African runner Caster Semenya has both male and female organs.

The Sydney Morning Herald in Australia and The Sun newspaper in Britain reported that gender tests ordered by the International Association of Athletics Federations (IAAF) show the 18-year-old is a hermaphrodite.

Neither paper named the source of their information. IAAF spokesman Nick Davies would not discuss the findings with CNN. "I simply haven't seen the results," Davies said.

"We have received the results from Germany, but they now need to be examined by a group of experts and we will not be in a position to speak to the athlete about them for at least a few weeks.

"After that, depending on the results, we will meet privately with the athlete to discuss further action." Has Semenya been treated fairly?
The IAAF issued a statement, saying no decision on the case will be announced until the experts can look at the results.

A final decision regarding the case is not expected before the IAAF Council meets in late November in Monaco, the IAAF said.

Davies also said the news reports should be treated with caution. The newspapers said extensive physical examinations of Semenya show she has no ovaries, but rather has internal testes, which are producing large amounts of testosterone. What is intersexuality?

Shule za Msingi Kufundishwa kwa Kiingereza???

Duh! Makubwa! Kama shule za Msingi Tanzania zitafundishwa kwa Kiingereza (English) itawasaidia wanafunzi wakienda kusoma shule za sekondari na vyuo. Kwa sasa waTanzania wanaosoma kwa kiswahili halafu ghafla wanatupwa katika shule ya kiingereza wanapata taabu sana. Matokeo yake ni kuwa sisi WaTannzania tuna kipaji kidogo katika English ukilinganisha na wenzetu kutoka Kenya na Uganda.

Use of Kiswahili will be consolidated and that of English expanded

The proposed new education policy has highlighted the importance of using English language as a medium of instruction in primary schools in the country, ‘The Guardian’ has authoritatively learnt.

A draft of the policy, whose copy was obtained by this newspaper this week from impeccable sources, also indicates that the government has given the green light to a section of private primary schools to use English as a medium of instruction due to requests from parents who favoured their children to be taught in English instead of Kiswahili.

The government notes in the report that the use of English had increased due to globalisation, thus necessitating making it a medium of instruction in primary schools in future.

However, the policy points to the heated debate in the country on whether English or Kiswahili be used as a language of instructions at primary school level.

“So there is need to consolidate the use of Kiswahili and expand the use of English as a medium of instruction in primary schools,” reads the policy in part.

It maintains that the languages of instruction would be both English and Kiswahili, but that English would only be used as a medium of instruction in private schools and taught as a subject in most of the public primary schools.

Kiswahili became the medium of instruction at primary schools shortly after independence while English is taught as a subject and used as a medium of instruction in secondary and tertiary education.

However, proponents of Kiswahili as a medium of instruction argue that using English as a medium of instruction would lead to giving the language more emphasis at the expense of Kiswahili.

This school of thought wants Kiswahili to become a medium of instruction from primary school to higher learning institutions.

The policy will be submitted to the Cabinet for approval in two months time before the final draft is relayed to the Parliamentary Social Services Committee for review, after which the Attorney General will prepare a bill from the national policy on education to amend the 1978 National Education Act.

The proposed policy will replace the current Education and Training Policy which has been in use since 1995.

The general secretary of Tanzania Association of Managers and Owners of Non Governmental Schools and Colleges (TAMONGSCO), Benjamin Nkonya welcomed the proposed policy, but said it was unjust for the policy to recommend the use of Kiswahili and English as mediums of instruction at primary school level but limit secondary schools to using English alone.

Nkonya said non-government schools had advised the government to endorse a system which would allow students to use one language as a medium of instruction from pre-school to tertiary level.

“We will make the problem worse if students who are taught in Kiswahili at primary level abruptly switch to English as a medium of instruction in secondary school. The decision will weaken the students’ creativity and their ability to learn new concepts.

“We want the two languages as mediums of instruction to be introduced at the secondary school level so that students may decide which way to go. A student who learned in Kiswahili in primary school should be given a choice to continue learning in the same language until he or she finishes the university,” said Nkonya.

Following failure to include such provision in the draft policy, Nkonya vowed that non-government schools through their coalition would make sure the provision is included before the policy is endorsed by the ministry of education.

Elizabeth Missokia, the Executive Director of Hakielimu, an educational NGO said in a telephone interview this week that NGOs dedicated to education would meet at the end of next week under the Tanzania Education Network (TenMet), a national network of more than 200 members to discuss the proposed policy and give their recommendations.

She said Hakielimu does not favour any of the languages being used as a medium of instruction but said there was need to distinguish between a language of instruction and language of communication.

The country needed English as a language of communication but Tanzanians needed to ask themselves if there were enough competent teachers to teach English as a medium of instruction or as a subject, she said.

“Teachers need to master the language they are using to teach. The quality of education is going down in Tanzania and Africa in general so we need to redefine and reflect what we want to achieve otherwise we will never get anywhere,” said Missokia.

Tanzanians always developed the best policies, but Missokia reckoned that the problem was the implementation of such policies, saying the education policy needed to put special emphasis on improving quality of education and teachers’ welfare rather than focusing on infrastructure development.

“It is important we start enrolling students who score division one and two into teachers’ colleges instead of those with division four…” she said.

According to the draft policy, English will remain the medium of instruction at secondary school level, but a research that was conducted by Martha Qorro, a senior lecturer in languages and linguistics at the University of Dar es Salaam titled: “Does Language of Instruction Affect Quality of Education?” says teachers and students at all education levels are able to debate and discuss and ask and answer questions and therefore generate knowledge when they understand the language of instruction.

“In Tanzania the language of instruction factor has been ignored for a long time and this has had a negative impact on the quality of education…..insisting on using English as the language of instruction in Tanzanian secondary schools and institutions of higher learning does more harm than good towards the provision of quality education as well as language teaching,” she concludes in her research.

Kwa tafsiri yangu nyepesi nyepesi, ufisadi ni wizi, udanganyifu, ulaghai, ubadhirifu, umaaluni, ufedhuli, ubaradhuli na mengineyo yanayofanana na hayo. Naam, mpenzi msomaji, nimeanza kuchombeza hivyo ujiandae kwa vionjo vinavyodhihirisha kirusi cha ufisadi kinavyozitafuna pia familia zetu. Kirusi hiki, ama kinabomoa nyumba zetu au kuzitia nyufa, na zaidi kinazisambaratisha kwa baba na mama, kila mmoja kufikia hatua ya kutafuta sehemu ya kujishikiza nje ya ndoa.

Kwanini hali hii inatokea? Je, ni umasikini ndani ya familia? Au ni utajiri umewakolea kiasi cha kupagawa na hivyo kutafuta maisha mbadala pembezoni? Au ni kitu gani hasa! Majibu yote haya msomaji wangu utayapata ndani ya mtiririko wa makala hii.

Hivi majuzi yupo fundi ujenzi wangu alinisimulia kisa kimoja ambacho kilinivuta kimawazo nikaona nikimwage hapa, ili pengine kirekebishe wenye mwelekeo huo. Hakifurahishi, lakini kina mafundisho muhimu ya kimaisha.

Katika simulizi yake, fundi huyu anasema kwamba yupo baba mmoja wa makamo mwenye mke na watoto wake wanne, wawili ni wasichana. Wawili wako sekondari, wengine vyuo.

Familia hii ina mji kule Mbagala wenye nyumba ya kisasa yenye eneo lenye nafasi.

Jirani na nyumba yao wakaamua kuanzisha baa na duka. Hapo huja wateja kununua na kuondoka na wengine huketi na kupata vinywaji, nyama choma.

Wazee hawa(baba na mama) wa mji huu, nao mara kwa mara huwa sehemu ya wanywaji. Pale hupata fursa ya kukutana na wezee wenzao kubadilishana mawazo. Ni wakamata maji wazuri na yakiwakolea hawasiti kuzua mitafaruku.

Unajua tena, wagidaji pombe ikiwakolea adabu na heshima huchepuka, hivyo kutoa fursa kwa ibilisi kulaghai. Simile hutoweka kwa wengine na kuanza kuongea ovyo.

Unaweza kudhani wanapofanya hivyo wanatania kumbe ni kweli toka kwenye nafsi zao zilizolegezwa na kilevi. Mfano mtu anamwambia mke wa rafiki yake eti ‘nakutamani sana’, na maneno haya anayasema mbele ya mumewe.

Je, mume mtu ataelewa kuwa ni utani? Ipo mitafaruku iliyoibuka kutokana na utani wa aina hii. Na pengine aliyetamka maneno hayo hakuwa anatania bali alimaanisha hivyo kupitia ibilisi wake wa pombe.

Kwa maelezo ya fundi huyu, wazee wa familia ninayozungumzia mara nyingi wamekuwa wakizozana wakiwa wanakunywa kwenye baa yao hiyo na zaidi ni wivu. Hofu yao ni kwamba huenda kila mmoja anao wateja anaowahusudu wanapokuja kunywa mahali hapo.

Baba anamshuku mume kuwa anao kinamama anaoonekana kutaniana nao au kuongea nao sana na huenda mmojawao ni mpenziwe wa pembeni. Na baba vivyo hivyo huhisi kuwa mama ana wazee anaochekacheka nao sana au vijana na huenda wapo anaowahusudu. Ili mradi kila mmoja anamtilia shaka mwenzake.

Chanzo cha mzozo wote huu ni uwepo wa baa hiyo karibu na nyumbani. Pengine isingekuwepo na kila mmoja angevinjari kivyake na migongano ya aina hiyo isingeonekana.

Kwa mtizamo, mama ndiye anayeonekana chakaramu zaidi na mshekumsheku anapoona wanaume, tofauti na mumewe ambaye ni mpole, mkimya ila mpepesaji mzuri wa macho anapoona kinamama au wasichana wanapitapita mbele yake wakija kupata huduma kwenye baa hiyo.

Upole na ukimya wa baba huyo, ulimzidishia mkewe jeuri kwamba hawezi kufurukuta. Hata ndugu za mume hufikiria mara mbili mbili kwenda kumtembelea ndugu yao(mume) kutokana na ukali wa mke.

Ilitokea mama huyu akamgundua mumewe akimkazia macho mwanamama mmoja. Hali hiyo ambayo ilikuwa ikijirudia mara kadhaa, ilimfanya mke ampige marufuku mwanamke yule kutokanyaga kwenye baa yao.

Hisia kuhusu mahusiana ya baba huyo na mwanamke huyo zilipelekea mkewe kumbonda mara nyingi kila wanapokolewa pombe na kutafutiana vijisababu vya kukosana. Na kila zikizuka vurumai, baba huchukua kibegi chake na kutokomea. Inaelezwa kuwa huenda kulala gesti.

Lakini kumbe halali gesti huenda kujichimbia nyumbani kwa mwanamke yule yule anayesababisha mipasuko ndani ya nyumba yao. Na mwanamke huyo baada ya kufukuzwa kwenye baa ile akaapa kutomwacha mzee huyo hadi kieleweke.

Misukosuko ambayo mume huyo alikuwa akipata kwa mkewe ilikuwa kama kichocheo cha kuzidi kumpenda mwandani huyo wa pembezoni.

Fumba na kufumbua mwandani huyo akapata mimba na kukaa sawa mtoto akazaliwa. Mtoto dume.

Taarifa zilipomfikia mama mwenye nyumba inaelezwa hadi sasa ameshikwa na bumbuwazi, na mume naye ndiyo amekuwa mbogo haoni wala hasikii.

Tena humpasulia wazi kwamba nakwenda au nimetoka kwa mke mwenzio. Naye mwandani huyo kila anakopita anatangaza ushindi kwa kumuopoa mume wa mwanamke mwenzake. Ufisadi mkubwa huu. Inauma lakini maji yakimwagika si hayazoleki?

Mpenzi msomaji, huo ndio ufisadi niliogusia tafsiri zake nyepesi nyepesi mwanzoni mwa makala haya. Ukali wakati mwingine huleta kilio. Kumbe pengine hekima ingetumika hata mpasuko uliojitokeza ndani ya familia hii usingekuweko. Hii ni kutokana na ukweli kwamba hekima ni bora kuliko kutumia nguvu. Na kwamba afadhali kusikiliza maneno matulivu ya mwenye hekima kuliko kusikiliza kelele za mfalme katika kikao cha wapumbavu.

Ufisadi mwingine unaozibomoa nyumba zetu ni huu unaofanyika kupitia simu za kiganjani. Mtu anamdoea mke au mume wa mwenzake na kisha anatumia ujumbe wa simu kumchanganya.

Wenye mahusiano ya kimapenzi nje ya ndoa zao wameshaonja joto la kasheshe zinazotokana na ufisadi huu. Na wenye kiherehere zaidi ni wale washikaji wa nje ya ndoa. Hao huwa wakali kuliko wenye nyumba zao. Kisa wanawaonea wivu na wanaponogewa hudiriki kubomoa nyumba zilizojengwa kwa gharama kubwa.

Anachofanya yule dowezi ni kutafuta simu ya mke wa mshikaji wake na kumtumia maneno ya kashfa kumdhihirishia kuwa mumewe anamdhibiti. Tabia hii wanayo sana wanawake.

Mwingine hupagawa na kuamua ku-forward ujumbe aliotumiwa na mume wa mwanamke mwenzake ili kumringishia kuwa hayuko peke yake na kwamba mumewe anaye kila anapomhitaji. Huu ni ufedhuli, ubedui, umaaluni, ufirauni wa hali ya juu.

Nyumba nyingi zimejikuta katika mpasuko mkubwa kutokana na mahusiano nje ya ndoa. Nyumba inachipuka ndani ya nyumba(nyumba ndogo hizi). Hata mtu akiona mwenzake akapatwa na balaa fulani, badala ya kujifunza na kuepuka, naye hujitosa kama vile shamba la majaribio. Matokeo yake naye anatumbukia.

Kwa ujumla mipasuko ndani ya familia zetu tunaisababisha sisi wenyewe. Kama baba na mama wako imara, hawatamani vya nje, hata Mungu hubariki nyumba hiyo na kuwa imara. Zipo nyumba chache za aina hii. Nyingi ni zile zinazoiga eti kama yule kafanya vile kwanini na mimi nisifanye hivyo. Kumbuka kuiga tembo ku… utapasuka msamba. Au siyo? Maisha Ndivyo yalivyo.

Steven Kanumba Chini ya Macho ya BIG BROTHER


Wadau, mcheza sinema maarufu wa Tanzania, Steven Kanumba aka. Denzel wa Tanzania alikuwa ndani ya nyumba ya Big Brother huko Afrika Kusini kama STARMATE. Alikuwa pamoja na wasanii wengine kutoka nchi zingine za Afrika. Kazi yao ilikuwa kuwakaribisha washiriki wa mwaka huu.

Nashukuru hakutuaibisha huko kama yule kijana, Richard, aliyedhalilisha akina dada na kuwafanyia 'mbaya' wakiwa wamelewa. Richard alishinda lakini bado anazungumzwa kwa uonevu aliyofanya.

After two fun-packed days in the house, the Starmates say their goodbyes to the Housemates. Wasichana Wanaopata Mimba Kuruhusiwa Kuendelea na Shule?

Wadau, nimefurahi sana kusikia kuwa huenda hivi karibuni wasichana wanaopata mimba wakiwa wanafunzi wataruhusiwa kuendelea na masomo yao baada ya kujifungua. Nakumbuka kuona wanafunzi wenzangu wengi kusimamishwa shule shauri ya ujauzito. Inasikitisha maana hali yao ya maisha inakuwa chini shauri ya kukosa masomo. Wengine walikufa kwa athari za kutoa hizo mimba.

Nilipouliza kwa nini wasichana hawaruhusiwi kuendelea na masomo, watu walisem, nani atalea hao watoto? Pia walisema eti itafanya wasichana wasitake kufanya ngono. Mbona wanafanya? Na je, kwa nini huyo aliyempa mimba kama ni mwanafunzi hasimamishwi masomo? Kazi kuonea wanawake!

Girls becoming pregnant while in school might soon be officially allowed to continue with their studies after giving birth.The remote dream will come true if the government endorses a provision in a draft of the new education policy recommending as much.

Allowing the girls to return to school will be an historic move after decade-long appeals from civil society organisations and the donor community to the government to revisit guidelines instructing schools to expel all girls medically proven to be pregnant.

The decision to produce guidelines stipulating procedures to be followed to reduce the incidence of schoolgirl pregnancies and readmitting schoolgirls put in the family way follows recommendations by a team selected by the government in 2007.

The team was detailed to collect views from education sector stakeholders on how best to address the problem of schoolgirl pregnancies.

It came up with findings showing that over 90 per cent of respondents from eight education zones wanted the girls back in school after delivery, while only two per cent stood against the idea.

Amnesty International estimates that some 14,000 schoolgirls were expelled from school in Tanzania between 2003 and 2006.

Winifrida Rutahindurwa, Gender issues coordinator at the Education and Vocational Training ministry, said when contacted for comment that only those schoolgirls becoming pregnant after the new guidelines are put into use would be allowed to return to school if the new policy is approved.

It is understood that the new guidelines will not come into effect before the draft of the new Education and Training Policy is assented to by the Education and Vocational Training minister later this year.

The policy will have to be sent to the Cabinet for approval in two months time before the final draft is relayed to the Parliamentary Social Services Committee for review, after which the Attorney General will prepare a bill from the national policy on education to amend the 1978 National Education Act.

But an education analyst who preferred anonymity said the bill is likely to face strong opposition from a section of Members of Parliament if it bears even a single clause allowing girls who conceive while attending school to continue with studies after delivery.

He said some legislators had shown strong support in previous debates in the House that such girls be expelled from school because they were seen to have misbehaved and thus deserved severe punishment.

“I know some MPs who will do anything and everything in their power to make sure the bill doesn’t sail through because of the feeling that such a move would fuel teenage pregnancies. But the truth is that these girls deserve to go back to school,” said the analyst, a long-serving educationist.

Speaking in a later telephone interview from Kilimanjaro Region, where she is on a mission to find out why Kilimanjaro had no cases involving schoolgirls dropping out of school due to pregnancy, Ms Rutahindurwa said readmitting such girls into school “is definitely not the best or only solution to the problem”.

Society had a role to play to make sure that girls remained in school and in sound health, she said, adding that poverty played a key role in sustaining the problem.

“Most schoolgirls become pregnant because of poverty, but culture also has a role to play in this because there are regions where girls are taught how to engage in sex at a very early age,” noted Ms Rutahindurwa.

According to the Basic Statistics of Tanzania (Best), an annual booklet that provides data on education in the country, Mtwara Region, where initiation ceremonies are common, had the highest dropout rate due to early pregnancies in 2007. More than 435 girls left school after becoming pregnant.

“Girls must be treated equally with their male counterparts. They must be given another chance to continue with education six months after giving birth, as medically recommended. I see this problem affecting poor people the most because it is they who can’t afford taking their children to private schools after expulsion. Our challenge right now is not only to return the girls to school but cut the cases altogether,” observed Ms Rutahindurwa.

According to the draft policy, the participation of girls in education at primary and secondary levels is lower than that of boys because of early pregnancies and changes ought to be made to make guarantee gender equality at all levels of education.

“The government will continue building more boarding girls’ secondary schools and extending the available ones… It will also come up with guidelines to enable female students who become pregnant to continue with their studies after giving birth,” part of the new policy reads.

It adds that the government would also come up with ways to punish all men involved behind schoolgirl pregnancies, but many observers believe that this is much easier said than done.

Tanzania Media Women’s Association (Tamwa) executive director Ananilea Nkya told this newspaper last year that there were no men who were known to have been prosecuted for impregnating schoolgirls. She suggested that the government and society were taking a stance too lenient to help out the victims, meaning the girls being put in the family way so prematurely.

Honolulu seeking to ban 'BO' on buses

HONOLULU – Stinky city bus riders soon could get soaked. The Honolulu City Council is considering a bill that would impose up to a $500 fine and/or up to six months in jail for public transit passengers convicted of being too smelly.

The bill will be heard Thursday in committee. It would make it illegal to have "odors that unreasonably disturb others or interfere with their use of the transit system."
It doesn't matter if it's body odor or offensive fumes that emanates from clothes, personal belongings or animals.

Councilmen Rod Tam and Nestor Garcia co-sponsored the anti-odor bill.

The American Civil Liberties Union of Hawaii says it is concerned with laws that are inherently vague, which opens the door to discriminatory enforcement based on an officer's individual prejudices.

MWANAFUNZI wa darasa la saba katika Shule ya Msingi Mariwanda B, Juma Sylvester (16), alipaswa kufanya mtihani wa kuhitimu elimu ya msingi mwaka jana. Badala yake, yeye na wenzake wawili Hurushi Wambu (16) na Ndamo Wambu (16) wakafunga mwaka 2008 wakiwa jela.

Watoto hao ambao wana umri chini ya miaka 18, wako jela ya watu wazima wakitumikia kifungo cha miaka mitatu kwa kosa la kuingiza mifugo katika eneo la mwekezaji kampuni ya Grumet wilayani Bunda mkoani Mara.

Vijana hao walitiwa hatiani Agosti 4 mwaka jana, katika mahakama ya wilaya ya Bunda na hakimu wa wilaya hiyo, Richard Maganga baada ya kukiri kosa la kulisha ng’ombe katika eneo hilo lililokodishwa kwa shughuli za uwindaji na uhifadhi kwa kampuni ya Grumet.

Sylvester au Gujoru Girabi, Wambu na Wambu wanatimiza mwaka mmoja gerezani huku mwenzao mmoja Juma Nyakire (15) akipumua baaada ya Mahakama Kuu kanda ya Mwanza kumfutia kesi iliyokuwa inamkabili kama hiyo, Agosti 5 mwaka huu.

Nyakire mwanafunzi wa darasa la sita katika shule ya msingi Kunzugu wilayani Bunda mkoani Mara pia alifungwa miaka mitatu Januari 2 mwaka huu, katika kesi namba 381/2008 kwa kuingiza mifugo eneo la hifadhi huku watoto wenzake wenye kesi namba 212/2008 na 282/2008 wakiendelea kusota jela.

Mwalimu mkuu wa shule ya msingi Mariwanda B, David Barijera anasema kufungwa kwa mwanafunzi wake, Juma Silivesta kumemfanya ashindwe kufanya mtihani wa darasa la saba mwaka jana.

"Kijana huyu alikuwa tayari kapewa namba ya mtihani ambayo ni PS/090/137/013 lakini hakufanya na alikuwa kati ya wanafunzi bora, lakini hiki kitendo cha kufungwa mwanafunzi wetu kimetusikitisha sana," anasema Barijera.

Unaweza usiamini unaposoma taarifa hii lakini hii ni hali halisi ambayo serikali ya awamu ya nne imelifikisha taifa hili. Sasa wawekezaji, kama alivyosema Mbunge ya Jimbo la Kyela Dk. Harrison Mwakyembe wanaonewa aibu na Serikali kama wakwe hata pale inapodhihirika wazi wamekosea .

Wakati taarifa ya matukio haya ikitolewa kwa wanasheria wa kituo cha haki na binaadamu (LHRC) mkoani Arusha , wakili wa shirika la kutetea wafugaji Pingos Forum na waandishi wa habari ilikuwa vigumu kuamini lakini baadaye yote yaliyoelezwa yalithibitika kuwa ni ukweli.

Watoto wadogo watatu, ambao walipaswa kulindwa na sheria zilizopo, wanatumikia kifungo huku kampuni ya Grumet ikiendelea na shughuli zake za kuvuna wanyama pori katika pori hilo la akiba ya Grumet.

Baada ya kuvuna wanyama pori, mwekezaji huvilipa vijiji saba vya wilayani Bunda jumla ya Sh 1.8milioni kila mwaka. Vijiji hivyo ni vile vinavyopakana na pori la akiba la Grumet.Mwenyekiti wa kijiji cha Mariwanda, Samson Kisung'uda anasema wakati watoto wao wanafungwa hawaoni manufaa ya mwekezaji huyu kwani hata hizo Sh 1.8milioni huwa hawazipati kwa wakati."Hadi sasa mwezi Agosti hajatupa hizo fedha.

Bajeti ya kijiji tayari imepita, mwaka jana alitoa mwezi wa 11 baada ya kulalamika sana serikalini na mwaka 2004 hakutoa kabisa hatujui nchi hii inakwenda wapi?"anahoji Kisung'uda.
Awali eneo hilo lenye mgogoro, katika mpango wa matumizi bora ya ardhi ya kijiji, lilitengwa kama eneo la malisho, lakini hivi karibuni liliingizwa kinyemela katika eneo la pori la akiba la Grumet jambo ambalo linawafanya wafugaji wa kijiji hicho kukosa eneo la malisho.

"Katika hili eneo Mto Rubana unapita na miaka yote tumekuwa tukipeleka mifugo kunywa maji sasa baada ya mipaka ya pori kuingizwa hadi sehemu ya kijiji ndio sababu kila mara wafugaji na wananchi wanakamatwa kwa madai ya kuingiza mifugo kwenye pori," analalamika Kisung'uda.
Eneo hilo ndiko walikoshikwa watoto hao wanaotumikia kifungo na akina mama wamekuwa wakikamatwa mara kwa mara wakienda kuchukua kuni za kupikia.

Kutokana na matukio hayo kijiji kimechoka. Mwenyekiti huyo anasema hawaoni manufaa ya mwekezaji huyo kwani serikali imeficha mkataba wake. Wanaitaka serikali iuweke wazi mkataba huo na ieleweke wazi kiasi cha fedha anazotoa kwa vijiji saba vinavyozunguka eneo alilokodishiwa na serikali ni za kisheria au msaada tu.

Diwani wa kata ya Hunyali, Sumera Kiharata ambaye vijiji vyake vinne vinapakana na mwekezaji huyo, anasema hata yeye kama diwani na mjumbe wa halmashauri kuu ya CCM wilaya ya Bunda hajui mkataba na mwekezaji huyo na serikali unasemaje.

"Hapa tuna mgogoro wa muda mrefu na jambo hili la kukamatwa watoto na kunyanyaswa wananchi tumelifikisha hadi vikao vya chama na serikali lakini inaonekana hakuna ufumbuzi kwani hata halmashauri ya wilaya haijui mkataba wa mwekezaji na serikali," anasema Kiharata.
Pamoja na malalamiko ya viongozi hao wa kata na kijiji, mkuu wa wilaya ya Bunda, Chiku Gawallawa anasema mwekezaji huyo, licha ya kuchelewesha fedha za vijiji na kukamata watoto, ana manufaa makubwa katika wilaya hiyo.

"Ni kweli kuna ucheleweshaji wa fedha, hilo tutalisukuma lakini huyu mwekezaji ni muhimu sana kwa wilaya nzima na hizo fedha za mwaka 2004 ambazo hawakupata vijiji zilitumika katika miradi mingine ya maendeleo," anasema Gallawa.

Kuhusu watoto waliokamatwa, Gallawa anasema walikubali kutumika kama ngao, pale wafugaji wanapovamia eneo la mwekezaji na kuingiza mifugo kwa kisingizio cha kufuata maji Mto Rubana.
"Ni kweli kuna watoto walishikwa kwa kuingiza mifugo eneo la pori la akiba la Grumet siku hiyo wananchi wengi walijitokeza kutaka kufanya vurugu na ili kujilinda waliwatanguliza mbele watoto kama ngao. Ila nadhani watoto walikwishaachiwa," anasema mkuu huyo wa wilaya bila kuwa na uhakika juu ya mahali waliko watoto hao.

Migogoro, mkuu huyo wa wilaya anakiri kwamba imekuwa mingi katika wilaya hiyo kutokana na kuwepo wafugaji ambao ni wahamiaji haramu, hatua ambayo inalazimisha kuendesha operesheni ya kuwaondoa wafugaji hao.

Anasema mifugo mingi imevamia wilaya hiyo hatua ambayo inasababisha kukosekana kwa eneo la malisho hadi kufikia wananchi kung’ang’ania kuchungia mifugo eneo la pori la akiba la Grumet.
Mkuu wa wilaya inaelekea hajui kitu maana taarifa yake hiyo inapingana na taarifa ya meneja wa pori la akiba la Grumet, Mathias Rwegasira anayesema wilaya hiyo inayozungukwa na mapori ya akiba na hifadhi ya taifa ya Serengeti, inakabiliwa na tatizo kubwa la ukosefu wa malisho ya mifugo.

Anasema tangu pori hilo lilipotangazwa rasmi mwaka 1994 kumekuwa na migogoro ya mipaka hasa katika kijiji cha Mariwanda kutokana na wananchi kudai kuna eneo lao la asili na malisho limeingizwa katika eneo la pori la akiba.

"Huwa wanakuja ofisini wanaomba kibali kwenda katika eneo hilo ili kufanya mambo yao ya asili na tumekuwa tukiwapa kibali lakini tatizo kubwa ni kuingiza mifugo," anasema Rwegasira.
Meneja huyo anasema kampuni ya Grumet ina mkataba na serikali kuwinda kitalii na kuhifadhi eneo la ukubwa wa hekta za mraba 400 katika pori la Grumet na nyingine 500 pori la Ikirongo huku eneo la Ikoma sasa kumeanzishwa hifadhi za jamii (Wildlife Management Area-WMA).
Wananchi wa Bunda ambao wanaishi katika vijiji vinavyopakana na mwekezaji, wanasema wao hawapingi uwekezaji ila mazingira ambayo serikali inayaweka kwa kuwakumbatia sana hata wawekezaji wanapokiuka sheria ndicho wanacholalamikia.

Hata hivyo, Rwegasira anakiri kuwepo malalamiko ya wananchi juu ya mwekezaji huyo, lakini anasema miaka ya hivi karibuni wamejitahidi sana kuyapunguza kwani awali askari wa mwekezaji walikuwa wakilalamikiwa sana.“Hata kamati ya bunge ilifika hapa na kuulizia masuala haya ila tunajitahidi kuyashughulikia na sasa matatizo yanapungua kwani awali askari wa mwekezaji walijipa madaraka makubwa na hivyo kusuguana na wananchi," anasema.

Kuhusu kukamatwa na kufungwa watoto watatu, Rwegasira anasema yeye hana taarifa hizo japo kuwa alikiri kuwahi kusikia malalamiko alipotembelea vijiji vinavyozunguka pori hilo.Wakati Gallawa na Rwegasira hawajui hatima ya watoto hao, Mkuu wa gereza la kilimo la Serengeti, Deogratius Rwanga anakiri gereza lake kuwa na watoto wawili kati ya hao watatu na siku hiyo walikuwa wameondoka asubuhi kwenda machungani.

"Ni kweli tuna hao vijana hapa ila muda huu wapo machungaji," anasema Rwanga. Hii ndiyo hali halisi ya wilaya ya Bunda ambayo inaacha maswali mengi ni kipi kipaumbele cha serikali kati ya wananchi wake na wawekezaji.

Serikali imepiga marufuku maonyesho yote ya filamu kwenye hadhara ya watu, majumba yasiyo rasmi, hoteli na maeneo ya baa bila kufuata masharti kwa mujibu wa Sheria.

Agizo hilo limetolewa jana jijini Dar es Salaam na Waziri wa Habari, Utamaduni na Michezo, George Mkuchika, wakati wa uzinduzi wa Bodi ya Ukaguzi wa Filamu nchini ambayo itakuwa na jukumu la kukagua na kusimamia maonyesho na shughuli za filamu nchini.

Aidha alisema serikali iko makini kuhimiza na kusisitiza matumizi ya sanaa katika masuala mbalimbali ya maendeleo na kuvitambua , kuvikuza na kuviendeleza vipaji vya wasanii katika kukuza taaluma na fani ya filamu nchini.

Awali akizungumza kuhusu majukumu ya Bodi hiyo, alisema kuwa Bodi itakuwa na jukumu la kuweka misingi ya kuimarisha utaratibu wa usimamizi wa utengenezaji wa filamu na pia kutoa vibali vya kutengeneza filamu hapa nchini.

Naye Mwenyekiti wa Bodi hiyo Bi. Rose Sayore ameihakikishia serikali kuwa Bodi yake itafanya kazi kwa mujibu wa sheria na kuhakikisha kuwa kanuni, sheria , maadili na taratibu za uonyeshaji na utengenezaji wa filamu zinazingatiwa kwa maslahi ya watanzania na vizazi vijavyo.
