Court orders Lulu’s lawyers to Provide proof on her Age

Monday, 11 June 2012
By Rosina John

The Citizen Correspondent

Dar es Salaam. The High Court in Dar es Salaam yesterday ordered defence lawyers of movie actress Elizabeth Michael alias Lulu to present documents supporting their claim she is under the age of 18.Judge Fauz Twaibu ordered the defence lawyers to present the evidence and supporting documents by way of affidavit on June 13.

Lulu is charged at the Kisutu Resident Magistrate’s Court with murdering local movie star Steven Kanumba on April 7, this year, at Sinza Vatican.

Defence counsel led by advocate Peter Kibatala filed the application at the High Court seeking the determination of the accused’s age. The lawyers stated that Lulu has not attained the age of 18 years to merit prosecution in an adult court.

The application by Mr Kibatara followed a decision by the lower court to turn down their request to transfer the murder case to a juvenile court on the ground that the lower court lacked jurisdiction to entertain the matter. However, in his ruling yesterday, Judge Twaib quashed and set aside the decision by the resident magistrate’s court to refuse to entertain the application, saying it was an error in law and an abdication of duty.

“Consequently, I hold that the lower court was wrong to refuse to entertain the application, thinking that such an enquiry could only be done by this court.

I quash and set aside the decision of the Kisutu Court,” the judge ruled.

The judge said that, considering the seriousness of the charge facing the applicant and the urgency of determining whether or not the applicant is entitled to the benefits of the Child Act and in the interest of justice, the court is invoking its supervisory powers under Section 44 of the Magistrate’s Court Act and shall proceed to determine the correct age of the applicant in terms of Section 113 of the Child Act.

The judge said that the nature and seriousness of the charge facing the applicant, the lack of any possibility for securing bail, during the pendency of the charge and undisputed urgency of the matter require that the controversy about her age be determined the soonest.

He further ruled that, in the meantime, the proceedings of the murder case at the lower court should stay, pending determination of the applicant’s age in the High Court. The judge ordered the applicant’s counsel to produce evidence on their client’s age on June 13 while prosecution required submitting their reply on June 20 while the hearing would be on June 25.

LULU: That Girl! Kasichana Kale!

Gazeti la Global Publishers

Gazeti la Global Publishers Mwaka Jana

LULU: That Girl! Kasichana Kale!

By Jacqueline Mgumia

Dear TGNP members, young feminists and those in support of our sisters, I think we have a role to play in understanding Lulu's case, its context and her future charges in relation to Kanumba’s death. This portrays a classic relationship between private and public life.

I think it is a platform for expanding and demanding for women’s right issues in our current context - the media space. We should follow up the tragedy to understand what is at stake in relation to women’s rights, images and representations on the media and legal spaces, specifically how domestic spaces make life so vulnerable.

Thus far, Lulu is in rumande, accused, suspected, or associated with Kanumba's death. Unfortunately, public opinion is against Lulu as she is condemned and demonized for her loose sexual conducts, a fact which could easily forge her rights in regard to the accusations or, if found innocent, her security in the public domain will be threatened.

I am not saying she is innocent, but I always wonder why only young superstar women are labeled as loose or malaya! And, yes, if she has been malaya or bad, so what? Is this only bounded/confined to a moral question? Is this about good girls and bad girls? Does this mean she deserves to be accused without being listened too? Does this justify one being declared guilty without a fair trial or being understood?

Some people say YES! Kaache kasote rumande ama kaende jela, maana, asiyefunzwa na mamaye atafunzwa na ulimwengu! I say NO, mnyonge mnyongeni lakini haki yake mpeni!

This is not a claim for being guiltless, rather it is a call to allow police and medical practices as well as procedures to rule the investigations, not the hyped media opinion of kale kasichana.

Justice is for everyone, those good and bad, those present and absent. If the investigation finds any association or relation of her conducts to be incriminating that will be a different question of the law and lawyers will choose positions.

Human right activists, feminists and the media, how do we associate ourselves with those labeled bad or indeed bad on culture lenses? Do we choose to remain in silence on whose lenses we are trading?

I speak not because she is a woman and young, as that could be doing injustice to our late Kanumba and being biased on a purely gender stance, rather it is to engage with the notion of good and bad girls in the media and its implication on women representation in general, and especially in our digital generation.

Lulu is still in rumande, maybe a quick and quiet visit will help us understand what is happening to her and perhaps make a decision if it is a case we might want to follow. We should start by getting facts right by acknowledging that Lulu is prejudged because of her character, and that can never be right or fair.

This is not about Lulu, it is about Wema, Ray C, Yasinta, and many young women like her in the movie and music industry; the platform is rough and tough, providing different experiences to female artists, of which we know very little about.

We need to start engaging with these spaces, as these young women define the good and bad girls in subtle but very important ways!

This is not about that girl! It is about understanding what is happening in domestic spaces, where both men and women rights could easily be abused in silence. It is about engaging with misunderstood women using our lenses to make sense of their stories and realities so as to inform ourselves on diverse issues facing women. It is about understanding the perceptions and cultures that influence practices and outcomes of laws.

I pray for Kanumba the Great that he may rest in peace and, at this point, I should declare that he was one of the Tanzanian actors that I gave respect to for his achievements; however, his latest movie MOSES, which is centered on hate on women, left me wishing to meet him and chat about impacts of such contents on women. Indeed he has left us very young. He will be greatly missed.

As he rest in peace tomorrow and justice is found for his sudden death, let Lulu - before the law and public - be judged and treated with fairness regardless of being that girl - kasichana kale!

Lulu kortini kwa kumuua Kanumba

Polisi wamficha, wakwepa waandishi
Ajifunika ushungi, avaa kandambili

Mohamed Gharib Bilal.

The Citizen Reporter

Dar es Salaam. The prime suspect in the death on Saturday of local film star Steven Kanumba spoke out on the tragedy for the first time just a day before tens of thousands of people gathered for his funeral yesterday.Elizabeth Michael, alias Lulu, broke her silence on Monday—two days after she was arrested. Investigators at Oysterbay police station had to engage a crime psychologist to get her to open up on the events leading up to the death of the star who had just been invited to Hollywood in the United States.

Highly placed police sources told The Citizen in an exclusive interview yesterday that Lulu, girlfriend of the deceased, started narrating what had transpired on the night the 28-year-old died after meeting the psychologist.

“The suspect, who had refused to cooperate with police detectives from the Kinondoni regional police office, has now managed to speak for three hours with the psychologist,” the sources said on condition of anonymity since they are not official spokespersons of the Tanzania Police Force.

The psychologist from the Criminal Investigation Department (CID) headquarters in Dar es Salaam chatted candidly with the suspect for three hours on Monday, a day before Kanumba was buried.

Lulu reportedly told the investigators that Kanumba phoned her on the fateful night asking her to join him for an outing. She went to his home but told him she did not really want to go out and that she preferred to return home.

Kanumba allegedly wanted Lulu to accompany him to a Mashujaa Band show at Vingunguti, and became furious when she refused to accompany him.

According to the sources, the misunderstanding between the two developed into a quarrel, with Kanumba demanding to know what it was that she had left at her home.“According to Lulu, the deceased locked the door to his room,” said the sources. “In a panic, she unlocked the door and fled.”

Lulu is quoted as saying that she managed to escape after he fell and had no idea what transpired after her departure.

The sources said police have also interrogated another suspect, a Bongo Flava musician (name withheld), who gave Lulu a lift when she left Kanumba’s Sinza residence. “I am sorry, brother, I cannot comment on that issue,” he told The Citizen before he hang up.

According to detectives, other suspects have also been lined up for questioning. The sources could not say how long the interrogations would take.

In another development, the sources said heavyweight politicians related to Lulu have been sending her consolation text messages pledging to assist her. “Their involvement with the suspect could complicate our investigations,” said the sources.

Yesterday, this paper reported that Kanumba died of a brain injury caused by a sudden blow to the head.

One of the doctors who examined Kanumba’s body at Muhimbili National Hospital hinted that the actor died on the spot after suffering such severe brain damage that he collapsed and stopped breathing.

His sudden death sent shockwaves across the country, East Africa and West Africa—particularly Ghana and Nigeria—where he had achieved prominence in the continent’s leading film industry, Nollywood. He had returned home from a trip to Ghana just a few days before his death.

President Jakaya Kikwete joined mourners on Sunday, calling the fallen star a brilliant ambassador who sold Tanzania far and wide through the screen.

REST IN PEACE STEVEN KANUMBA! IT IS  HARD TO BELIEVE YOU ARE REALLY GONE.

The late Steven Kanumba

By Songa wa Songa

Dar es Salaam. Fallen movie star Steven Kanumba had won a chance to make what would have been a historic debut of a Tanzanian actor in Hollywood, we can report today.

The Citizen can also reveal that Kanumba was planning to permanently settle as a husband and father, all dreams which have now evaporated with his death on Saturday.

New details emerging now as the country continues to mourn the passing of the iconic actor indicate that he was set for unparalleled trajectory ever attained by a local film artiste as a Hollywood role would have not only added to his fame on the global stage, but also come with a hefty pay cheque.

Based in the United States, Hollywood is the epitome of the world movie industry and rakes in billions of dollars in annual revenues and has made millionaire actors even for the simplest of hit appearances.

Held closely to his chest, Kanumba had just arrived from Ghana a few days ago where he apparently won an audition for a Hollywood appearance.

“He was heading there not as an inspiration seeker like he did in the past but this time to work. He had his US visa ready but fate dictated otherwise,” revealed Mr Dennis Sweya popularly called Dino, a friend of Kanumba since 2003 when they first met in the start-up days at Kaole Sanaa Group.

“When he broke the news to me, I told him; ‘The Great’ once you make it, don’t forget me in your ‘kingdom’ and he replied ‘I will never forget you my brother,” said Dino.

The news of the US job was given credence when Kanumba’s mother Ms Flora Mutegoa told Journalists that her son called and asked her to urgently return to Dar es Salaam for a meeting ahead of his departure.

The mother was away in Kagera Region visiting the actor’s maternal grandmother and received the call on the same night that he died. Friends say mother and son were not only family but great friends.

Meanwhile, before his untimely demise, Kanumba was deeply longing for a family of his own.

Those who knew the person behind the personality say ‘The Great’ wanted to have children more than anything else and prayed to God to bring him the right woman to marry.

“He longed for the warmth of a family of his own to complement the success he had achieved so far,” said Dino who recalled that during his last meeting with Kanumba, the actor had played and joked with his kids while expressing his wish to have his own.

Yvonne Cheryl, an actor popularly known as Monalisa, said she had been taken aback by Kanumba’s great love for children seen in his recent works.

“He was not only making movies for children; he was making friendship with children of late and my own child was his best friend…they called each other and talked over the phone several times,” she said.

Kanumba’s friend and career rival Vincent Kigosi, also known as Ray, said his last work-in progress, Ndoa Yangu, which literary translates to My Marriage initially scheduled for release this month and his recently new-found film niche (for kids) told volumes on how he felt about family.

“I will remember and immortalize his work and life by making movies for children as he did during his last days,” said Ray.

In his recent interviews, Kanumba faulted those who envied his ‘little’ success, asserting that the last time he checked his vision and mission, he was not there yet.

“I feel proud to be a source of inspiration to many aspiring actors and actresses but I want everyone to understand that I have not yet achieved my biggest dream” he once said.

He said the two had purchased an expansive piece of land at Mbezi Mpiji with the vision of developing it into a Tollyhood village—residential villas and offices exclusively for the film industry.

But according to Mr Chiki Mchoma, the Bongo Movies coordinator, Steve Kanumba somehow knew that death had come very close to him. He says Kanumba called him one week ago, praised his work and said he wanted to talk to him in details.

“I was at the border on my way to a neighbouring country, so we did not talk much. But when I came back I met another friend whom Kanumba had also called and learned that he had bought a new Bible, wanted to meet and talk to all his friends; tell them their shortcomings and apologise for his own weaknesses and wrong doings” he said and added:

“I think he has died without accomplishing this noble mission…it is something he really wanted to do and he insisted on meeting in person.

The death of Steven Kanumba has sent both the national leaders and ordinary citizens into a deep sorrow with a huge crowd of mourners of all ages flocking his Sinza home since early Saturday morning throughout Easter Sunday.

Meanwhile, President Jakaya Kikwete yesterday led thousands of mourners in consoling the family, including Kanumba’s mother who was seemingly overwhelmed and remained speechless.

President Kikwete said the death of Kanumba has robbed Tanzania of its finest performing art ambassador at a time when his services were needed the most.

“I was scheduled to travel outside the country but upon receiving the sad news I decided to postpone the trip so that I could join you (Kanumba’s family), fellow Tanzanians and all his fans all over the world in mourning his demise,” he said

According to a programme issued last night, mourners will pay their last respects to Kanumba tomorrow at Leaders’ Club in Dar es Salaam before his burial at the nearby Kinondoni cemetery later in the day.

Meanwhile, the Kinondoni regional police commander, Assistant Commissioner of Police (ACP) Charles Kenyela, said last night police were continuing with investigations into Kanumba’s death.

He said the Police collected samples of drinks found in the room of the deceased and sent them to the chief government chemist for tests.

ACP Kenyela added that the police were also awaiting a postmortem report on the body of Kamumba from Muhimbili National Hospital pathologists.

The police are still questioning the 18-year-old girlfriend of the deceased identified as Elizabeth Michael alias Lulu.

Mystery surrounds movie star’s death
Saturday, 07 April 2012 21:39

The Citizen Reporters

Dar es Salaam. Police are busy trying to resolve a mystery surrounding the shocking death of movie star Steven Charles Kanumba, who died in Dar es Salaam yesterday, shortly after picking a quarrel with his girlfriend.

The Bongo movie iconic actor, 28, was pronounced dead on arrival at Muhimbili National Referral Hospital where he had been rushed by his doctor, a family member and close friends. He died at around 3am.

The Kinondoni Regional Police Commander, Mr Charles Kenyela, said Kanumba had been rushed to the hospital unconscious from his city home in Sinza suburb.

“Initial reports indicate that he fell in his bedroom where he was with the 18-year-old girlfriend identified as Elizabeth Michael,” said Mr Kenyela. The girl, also an actor commonly referred to as ‘Lulu’, has been cohabiting with Kanumba for some time now.

Mr Kenyela confirmed they were holding Ms Lulu for questioning. She was still locked up at the Oysterbay police station last night.

The police chief said investigations were still in the initial stages, and as such, it was too early to draw conclusions on the cause of the death, but promised to issue a detailed statement upon completion of the exercise. He confirmed that a postmortem was also underway at the hospital’s mortuary.

According to Mr Kenyela, Lulu told them that Kanumba fell down and hit his head on the concrete wall and passed out on the spot. “She said the deceased just slumped to the ground and hit the concrete once they were in the bedroom,” he said in a telephone interview with The Citizen.

He said the girl told the police Kanumba had picked a quarrel with her after they had arrived home at about 1am, over a telephone call she had received a short while earlier.

“Lulu claimed when he got aggressive, she attempted to run away but Kanumba caught up with her outside the gate and took her back to the bedroom. She says he collapsed as soon as he locked the door and hit the wall,” Kenyela explained.

The police took from the scene a glass and bottle of whisky which the deceased was believed to have been drinking. Other witnessed claimed they also saw them dust the wall and also take away a sword found in the bedroom.

News about the death spread fast and shocked the nation where the self made actor had attracted tremendous following and liking for his quick success in the film industry spanning almost decade.

His talent not only made him a household name locally, but also in other countries like Rwanda, Burundi, DR Congo, Ghana and Nigeria, if social network post yesterday are anything to go by.

Thousands of fans rushed to the hospital as soon as they got wind of the incident. The crowds welled by the second outside his house gate, forcing the police to intervene to cordon the highway for smooth traffic flow.

Fellow actors wailed uncontrollably and some fainted on arriving at the home to join other mourners, whom included Cabinet ministers, and top public and private sector executives.

The grief galvanized the entire nation and other countries where Kanumba had made a name for himself as one of the rising actors in the continent. A close friend and South Africa based Tanzanian model Happiness Magesse could not hold her tears and broke on national television during an interview in the morning.

At Muhimbili, close associates and comrades cried and huddled in disbelief when they witnessed his body being removed from his brand new Toyota VX land cruiser and wheeled him into the mortuary.

The super star’s burial plans would likely be announced later today as his mother was being awaited last night from Bukoba town where she is based.
