Aliyemtukana Rais Kenyatta wa Kenya Kwenye Mtandao Ahukumiwa Kifungo cha Miaka Miwili!

Oh hoo! Nyie mnaotukana viongozi wa nchi mtakamatwa tu! Mnaona yaliyompata, kijana Alan Wadi Okengo (25) wa Kenya?   Kwenye mtandao alikuwa anajiita Luteni Wadi, alidhani Usalama wa taifa wa Kenya hawamjui. Loh!  Hamjui kuwa kila ukiingia kwenye mtando unaacha alama zako!  Walimkamata alivyokuwa anajaribu kutoka Kenya, huenda alikuwa anaelekea Bongo. Tukaneni tu, na siku wakiwapania mtakiona cha mtema kuni, kama alivyokiona Lt. Wadi.  Wadi alikuwa ni mwanafunzi wa mwaka wa nne katika Chuo Kikuu cha Moi.  Sasa anakwenda kuwa mke wa mtu huko gerezani.

A fourth-year university student will spend two years in jail for posting on social media unprintable insults against President Uhuru Kenyatta.
Alan Wadi Okengo, alias Lieutenant Wadi, was accused of posting the messages on his Facebook account on December 18 and 19 at an unknown place within Kenya.
Wadi, 25, a political science student at Moi University, was arrested as he attempted to sneak out of the country through the Busia border on December 31.
He was brought back to Nairobi CID headquarters where he was interrogated by cybercrime police sleuths.
Wadi, who looked composed, told Milimani Law Courts resident magistrate Ms Ann Kaguru that he was ready to “apologise to President Kenyatta personally if he was not handed down a custodial sentence.”
The charge against the university student stated that “the message he sent was calculated to to bring into contempt the lawful authority of the President of the Republic of Kenya.”
PLEA NOT FACTORED
His plea was not factored when he was he was being sentenced after pleading guilty to two charges of hate speech and demeaning authority of a public officer, contrary to Section 132 of the Penal Code.
In her ruling, Ms Kaguru said , “the offence is serious and a deterrent penalty is called for to serve as a warning to others abusing the social media forums.”
She proceeded to pronounce the sentence after saying that “he was convicted on his own plea of guilty.”
A state counsel, Mathew Karori, told the magistrate that the accused was arrested while he was about to cross the border through “panya routes” (unofficial exit) to a neighbouring country.”
Mr Karori urged the court to treat the remorseful student as a first offender although he said the abuse of the social media forum should be discouraged.
Wadi was accused of posting the two offensive messages when National Assembly passed the Security Laws (Amendment) Act No 19 of 2014 on December 18 and the following day when President Kenyatta signed the Bill to become law last year.
The first indictment was that he posted a hate speech message intended to stir up ethnic hatred between various Kenyan communities on the other by alleging a particular tribe should be deported to their home county.

Viongozi wa Afrika Wawe na Umoja

 Ni Ubaguzi au...? Kwa Nini Viongozi wa Afrika ndio wanaitwa huko Mahakamani?

ADDIS ABABA, Ethiopia (AP) - The African Union urged its members to "speak with one voice" against criminal proceedings at the International Criminal court against sitting presidents, according to a statement Saturday.

   The 54-nation organization said it was disappointed that a request to the U.N. Security Council to defer the trials of Kenya's leaders "has not yielded the positive result expected."  The African Union also has sought the deferral of criminal proceedings against Sudan's President Omar al-Bashir, who has been charged with genocide in Darfur.

   Only Botswana has opposed the stand taken by the African Union, made in a statement received Saturday after a summit in Ethiopia attended by 34 leaders.

   "African states parties should comply with African Union decisions on the ICC and continue to speak with one voice," the statement said, adding "There is an imperative need for all member states to ensure that they adhere to and articulate commonly agreed positions ..."

   Kenya's President Uhuru Kenyatta and his deputy William Ruto face charges of crimes against humanity at the international court at The Hague for allegedly orchestrating post-election violence that killed more than 1,000 people following a disputed presidential election in late 2007. Both men deny the charges.

   The International Criminal Court has recently come under strong criticism from African leaders who accuse it of racism in indicting only Africans. Countries such as Uganda have suggested they may decide to sever ties with the court in solidarity with Kenya. Some Africans also argue that the Kenyan leaders need to concentrate on governing their countries to ensure stability as the region faces unprecedented terrorist challenges.

   Ruto's trial continues at The Hague but the case against Kenyatta may collapse. Kenyatta's trial was to start in November but was postponed to February after the prosecution and defense teams said they needed more time to prepare. The prosecutor in December asked for an additional three-month adjournment after one witness withdrew and another said they gave false evidence.

   A Kenyan court on Friday refused to stop the arrest of a journalist wanted by the international court for allegedly interfering with prosecution witnesses in the case against Ruto.

African Union is Against Trial of President Kenyatta

   ADDIS ABABA, Ethiopia (AP) - The African Union's executive council condemned the International Criminal Court's charges against President Uhuru Kenyatta of Kenya as "totally unacceptable," Ethiopia's Foreign Ministry spokesman said Saturday.

   Kenyatta faces crimes against humanity charges for Kenya's 2007-2008 postelection violence in which more than 1,000 people died.

   The African Union council feels the Kenyatta's trial will hinder Kenya's fight against terrorism, said Dina Mufti. The AU's council proposed that Africans should deal with cases of genocide through an AU-backed court, and should not be forced to resort to the ICC in The Hague.

   These points will be presented to African heads of state attending a special summit on Saturday to discuss Africa's relationship with the ICC.

   Some African leaders have indicated their countries may sever ties with the ICC in solidarity with Kenya. Some African leaders accuse the ICC of disproportionately targeting Africans. The international court has indicted only Africans so far.
