Tanzania stands firm on aid-gay rights spat with UK


DAR ES SALAAM (Reuters) - Tanzania has become the latest African government to say it will not legalise homosexuality even if that means it loses substantial financial aid from Britain.
Government officials reacted strongly to Prime Minister David Cameron's threat to cut aid to countries that deny gay rights.
"Tanzania will never accept Cameron's proposal because we have our own moral values. Homosexuality is not part of our culture and we will never legalise it," foreign affairs minister Bernard Membe was quoted as saying by Tanzania's Guardian newspaper.
"We are not ready to allow any rich nation to give us aid based on unacceptable conditions simply because we are poor. If we are denied aid by one country, it will not affect the economic status of this nation and we can do without UK aid."
Tanzania, a former British colony and one of Africa's biggest per capita aid recipients, received $453 million (282 million pounds) of aid for its 2011/12 budget, with Britain the largest provider of general budget support.

Ghana's President John Atta Mills said Wednesday his government would never legalise homosexuality. Uganda has also reacted strongly to Cameron's comments.
The Department for International Development (DFID) gave Tanzania 144 million pounds in aid in 2009/10 and has pledged to spend an average of 161 million pounds per year in Tanzania until 2015.
Homosexuality is a serious criminal offence in Tanzania, punishable by imprisonment, but no one has been prosecuted.
"We cannot be directed by the United Kingdom to do things that are against our set laws, culture and regulations," Membe was quoted as saying.
Zanzibar President Ali Mohamed Shein also rejected the British demands for gay rights to be respected in Tanzania.
"We have strong Islamic and Zanzibari culture that abhors gay and lesbian activities, and to anyone who tells us that development support is linked to accepting this we are saying no," Shein told journalists Thursday.
Zanzibar, Tanzania's semi-autonomous archipelago, enacted a law in 2004 banning homosexual relations. Male offenders face more jail time, up to 25 years, than convicted women.
Homosexuality is illegal in 37 African countries, and rights groups say gays are often the targets of violent hate campaigns.

Katika hotuba yake, Dkt Kikwete aliwapa changamoto wabunge hao wa CCM waende kwa wapiga kura wao na kuwaelemisha kuhusu mchakato wa upatikanaji wa Katiba mpya uliopitishwa Jumamosi Bungeni Dodoma.

Dkt Kikwete aliwasisistizia wabunge hao umuhimu wa kupeleka elimu hiyo ya mchakato wa kupata katiba mpya kwani hivi karibuni kumekuwepo na upotoshaji mkubwa wa nini kinachoendelea, na kusema kuwa wakiwa wabunge wa chama tawala ni wajibu wao kuelimisha umma kwamba kanuni na sheria zote zimefuatwa katika kupitisha muswada huo ambao umesomwa kwa mara ya pili, baada ya kusomwa mara ya kwanza kwa mujibu wa sheria.

Rais Kikwete aliwakumbusha wabunge hao kwamba mchakato huo si jambo geni na kwamba ndio uliofuatwa na Marais wote toka wa awamu ya Kwanza hadi ya tatu, akisisitiza kwamba ni muhimu wanancho wote wakaelewa hilo, ikizingatiwa kwamba kuna baadhi ya watu wachache wanaotaka kupotosha umma kwamba hatua hiyo ni batili wakati sio kweli, ikizingatiwa kwamba kila lililo katika katiba ya sasa limezingatiwa.

Pia aliwasihi Watanzania kujitokeza kutoa maoni yao ya ni katiba gani wanayoitaka pindi muda wa kufanya hivyo utapowadia, na wasikubali kughiribiwa na wachache waliopania kupindisha ukweli.

Kwa mujibu wa ratiba leo Jumapili kutakuwa na Kikao cha Kamati ya Usalama na Maadili ukumbi wa White House kitachofanyika kutwa nzima, kitachofuatiwa na kikao cha Kamati kuu ya CCM Jumatatu na Jumanne. Halmashauri kuu ya CCM itakutana kuanzia Jumatano hadi Ijumaa.

Prof. Chris Maina Peter of UDSM Appointed Member of the UN International Law Commission

A Tanzanian distinguished Professor Chris Maina Peter (pictured) was yesterday voted Member of the United Nations’ International Law Commission (ILC) by the 66th UN General Assembly.

Announcing the results here yesterday, the President of the 66th United Nations General Assembly, Ambassador Nassir Abdulaziz Al-Nasser said Prof Peter is among the 34 members voted in the commission out of 49 candidates who had vied for the seats. A former Kenyan Attorney General, Amos Wako has also been voted member of the Commission.

Prof Chris Maina Peter, who is currently a Professor of Law at the University of Dar es salaam, was among13 contestants from the African continent who were vying for the nine slots reserved for the African
countries in the UN's legal body.

Prof Peter who is currently in Ethiopia for official engagement said " I am delighted for the honor and more so to my government for seconding my candidacy and a spirited campaign."

Other countries that fielded candidates from Africa South Africa, Kenya, Sudan, Libya, Algeria, Cameroon, Egypt, Malawi, Mozambique, Nigeria, Mali and Cote d'Ivoire.

Prof Peter will serve in the Commission for the period of five years effective January next year.

Prof Chris Maina Peter was born on 14th April 1954 and holds a Ph D in Law from the University of Konstanz in Germany. He once served as a Member of the United Nations Committee on the Elimination of the Racial Discrimination (CERD), United Nations High Commissioner for Human Rights, Geneva, Switzerland.

Prof. Peter has also published widely in the area of Human Rights, Humanitarian Law, Public International Law and Good Government.

Askari wa kikosi cha askari wa kutuliza Ghasia (FFU) Iringa watumia mabomu ya machozi na risasi za moto kuwatawanya wananchi waliovamia nyumba ya mtumishi wa Mungu kwa madai kuwa kuna watu 15 wanaodaiwa kufa na kuonekana katika nyumba hiyo ( misukule).


Wananchi hao wenye hasira kali zaidi ya 200 walitumia mawe kuwashambulia FFU huku wao FFU wakitumia mabomu ya machozi kupambana Huku wanahabari wa vyombo mbali mbali na askari polisi na mchungaji mmoja wakinusurika kuuwawa wakishambuliwa kwa mawe na wengine kuvunjiwa kamera zao na wananchi hao ambao walionyesha kuwachukia askari polisi pamoja na wanahabari ambao waliteuliwa na wananchi wenyewe kuwawakilisha katika kukagua nyumba hiyo bila mafanikio .


Tukio hilo lilitokea eneo la Frelimo katika Manispaa ya Iringa na kudumu zaidi ya masaa manne baada ya kuanza majira ya saa 8 mchana na kuendelea hadi saa 12.50 jioni .


Wakielezea juu ya tukio hilo wananchi hao walisema kuwa walipata taarifa kutoka kwa mmoja kati ya wananchi wa eneo hilo kuwa katika nyumba hiyo ya mfanyabiashara wa maji kumeonekana misukule 15 ambayo ilionekana ndani ya uzio wa nyumba hiyo.


Kutokana na uvumi huo wananchi kutoka pande mbali mbali za mji wa Iringa walifika katika nyumba hiyo na kuizingira kwa lengo la kutaka kuichoma moto kabla ya askari polisi kufika na kuwaomba wananchi kutofanya hivyo na badala yake kuteuwa wawakilishi ili kuingia ndani ya nyumba hiyo kujikagua misukule hiyo bila mafanikio .


Hata hivyo baada ya askari hao walioambatana na wanahabari zaidi ya sita kutoka vyombo mbali mbali akiwemo mwandishi wa habari hizi kushindwa kuona misukule hao baadhi ya wanahabari akiwemo mwandishi wa habari hizi waliamua kuruka ukuta baada ya kuona wananchi wakionyesha jazba zaidi .


Huku baadhi ya waandishi wakiongozwa na katibu wa klabu ya waandishi wa habari mkoa wa Iringa (IPC) Frank Leonard ambaye ni mwandishi wa gazeti la Habari leo wakilazimika kujifungia ndani ya nyumba hiyo baada ya wananchi kuanza kuishambulia kwa mawe .


Hali hiyo iliwalazimu askari polisi zaidi ya 10 walikuwepo kuanza kutumia mabumu ya machozi kuwatawanya wananchi hao ambao walikuwa wakiimba kuwa mmekela rushwa wote wanahabari,wachungaji na polisi hivyo lazima mchomwe moto .


Katika tukio hilo mabomu ya machozi zaidi ya 30 yalipigwa hewani huku wananchi wakizidi kuongezeka na kupelekea askari hao kuomba msaada zaidi wa askari wa FFU ambao walifika wakiongozwa na mkuu wa FFU mkoa wa Iringa Mnunka na kufanikiwa kuwatawanya wananchi hao .

Zaidi ya watu 10 walikamatwa na jeshi la polisi kwa kujihusisha na vurugu hizo huku watu wengine zaidi ya 20 wakiwemo wanahabari familia ya mfanyabiashara huyo ,mchungaji aliyefahamika kwa jina la Mang’uliso walijeruhiwa kwa mawe .


Kamanda wa polisi wa mkoa wa Iringa Evarist Mangalla hakuweza kupatikana kuzungumzia madhara yaliyojitokeza katika tukio hilo japo mwandishi wa habari hizi alishuhudia magari matatu likiwemo la polisi yakiwa yameharibiwa vibaya kwa mawe.

Uchaguzi Congo - Fujo Zaanza

(AP) - Congo's leading opposition presidential candidate has spent the first half of the monthlong electoral campaign in South Africa, but that did not stop him sending a bombshell from afar: Etienne Tshisekedi proclaimed himself president and ordered his followers to stage jailbreaks to free detained colleagues.

 His declarations, made by telephone from Johannesburg and broadcast live on a Kinshasa TV station on Sunday, have angered people near and far, with some suggesting it is a political death warrant.

On Thursday, when he finally left South Africa and launched his campaign belatedly in the northern provincial capital of Kisangani, he issued more combative statements, inciting his followers to "terrorize them because they have been terrorizing us for a long time."

 "That's it. I'm voting for Kabila," one enraged former supporter fumed at the website Congo Siasa, referring to President Joseph Kabila.

 Information Minister Lambert Mende called Tshisekedi's statements possible treason and criminal. He shut down the offending pro-Tshisekedi Radio Lisanga TV station.
 
The Ministry of Justice said it is investigating whether action should be taken against Tshisekedi, the 79-year-old venerable voice of opposition in Congo who is running for president for the first time.

On Friday, the prosecutor of the International Criminal Court, Luis Moreno-Ocampo, warned that the court in The Hague has jurisdiction in Congo.

  "We are paying particular attention to reports of inciting hatred, exclusion and physical violence by various political figures," he said.

While Tshisekedi remained in South Africa, the campaign at home has become increasingly violent, drawing concerned comments from dozens of civil society groups, the United Nations, the European Union, the African Union and the United States.

  A U.N. report this week blamed most violence on politically manipulated security forces. Mende criticized the report, saying it wanted to make martyrs of the opposition.

Since the electoral campaign opened Oct. 28, Tshisekedi's supporters have had clashes, some deadly, with police and Kabila supporters in several towns. Last week in Kinshasa, the capital, gunmen fired on Tshisekedi campaigners putting up posters, wounding two. In the southern mining city of Lubumbashi, Tshisekedi supporters had street battles with a rival opposition party. Sixteen people were wounded. Young people in the eastern city of Goma took to the streets and gunfire erupted after popular folk musician Fabrice Mumpfiritsa was kidnapped, reportedly by government intelligence agents. Mumpfiritsa, who had refused to sing songs supporting Kabila, was found three days later, legs and eyes bound and so badly beaten he had to be hospitalized.

  U.S. Ambassador James Entwistle wrote an article in which he exhorted all candidates "to put the good of the nation before personal, political ambitions" and to renounce the use of violence and incendiary statements.
 
The Nov. 28 elections for a president and for legislators are critical for the future of the mineral-rich but impoverished nation of nearly 72 million as it struggles to recover from back-to-back civil wars that killed an estimated 5 million. It drew in the armies of half a dozen countries before the conflict ended in 2003, though numerous rebel and militia groups still terrorize eastern Congo.
  
How the elections unfold will be a likely indicator of whether Congo is consolidating its fledgling democracy or returning to a state of widespread instability, according to the International Crisis Group.
 
Back in South Africa, Tshisekedi was meeting with members of the governing African National Congress as well as South African mining and agricultural companies. Spokesman Leonard Mulunda said Tshisekedi was campaigning for support.
 
Other aides indicated that needed to be in the form of money, partly to fund chartered jets for campaigning.

The aides, who spoke on condition of anonymity because the issue is sensitive, indicated Tshisekedi had come to charter a jet for campaigning. They charged parties in Kabila's ruling coalition had commandeered all available planes in Congo - charges that have been denied.
 
Congo has few tarred roads and planes are the only viable means of campaigning in a country that straddles an area the size of Western Europe.
 
Civil aviation authorities also denied a claim that they had refused landing rights to Tshisekedi, when he failed to arrive in Kisangani for a rally Wednesday.
   Congo analyst Jason Stearns, author of the book "Dancing in the Glory of Monsters," has predicted a close race, though Kabila appears assured of victory after Parliament revised the constitution to allow only one round of voting, instead of two. The opposition acknowledges they need to field a single candidate to have any chance at beating Kabila, but personal ambitions have got in the way of any agreement. Tshisekedi is backed by 18 parties and is considered the leading opponent among 11 presidential candidates.
 
This is probably Tshisekedi's only shot at the presidency, given his advanced age. He formed Congo's first opposition party in 1982 to combat the longtime dictatorship Mobutu Sese Seko. Back in the 1990s he first declared himself president, saying Mobutu needed to be "rendered harmless."
 
He again made the assertion during this year's campaign.

He claimed Kabila had lost all support and argued that "in a democracy, it is the majority who leads and I'm the head of the majority. So, I'm the president of (Congo), I am the actual head of state."

He went on to urge his supporters to forcefully free party members jailed in Kinshasa, Mbuji-Mayi and Lubumbashi, and to attack police or soldiers who tried to stop them.
 
If militants were not freed by Tuesday, he said his supporters should "mobilize everywhere and set free the supporters and other opponents and break all the prisons.

"And if, unfortunately, police officers and other soldiers come to bother them, then they should be taught a lesson. And if they flee to the camps, they should be hunted all the way out there and followed to their camp where they will receive a good punishment even in front of their wives and children!"
 
Such incitement has alarmed many who fear Congo's election could degenerate into a spiral of violence similar to the presidential dispute that ravaged Ivory Coast for months, killing thousands and displacing a million people before incumbent Laurent Gbagbo was bombed out of his underground bunker and forced to accept an electoral defeat.
   One blogger at Congo Siasa lamented that Tshisekedi "has signed his political death warrant" and suggested his anger reflected hopelessness at fighting "a cause lost in advance."
