Wadau,  jumatatu ijayo mahakama itasikiliza kesi kujadili umri wa Lulu Michael Kimemeta.  Lulu anashikiliwa na polisi kwa tuhuma za kumwua Bongo Superstar, Steven Kanumba.

Hayo ndio matokeo ya kutaka kukua haraka. Mwaka jana Lulu alifanyiwa Birthday Party kubwa ya kusherekea Birthday yake ya 18. Mwenyewe Lulu katika mahojiano na waandihi wa habari kasema ana miaka 18. Kakbiliwa na shitaka la kuua na sasa ana miaka  16 mara 17! Duh!  Msipende kukua haraka wadau!

 Court ruling on Lulu’s age set for early June

Dar es Salaam. The High Court will on June 11 rule on an application by lawyers of actress Elizabeth Michael alias Lulu seeking a court order to determine her age.

Judge Faud Twaib will give the ruling after both parties concluded their submissions yesterday whereby the prosecution asked the court to dismiss the application because it was filed contrary to the law.

Lulu is charged at Kisutu Resident Magistrate’s Court with murdering local movie star Steven Kanumba on April 7, this year, at Sinza Vatican.

Advocate Peter Kibatara filed the application at the High Court seeking an order to the lower court to determine the age of the accused.Mr Kibatara is requesting for the court to transfer the murder case to juvenile court because the suspect is underage.

According to the lawyers, the accused has not attained the age of 18 years to merit prosecution in the adult court.

However, the lower court said it has no jurisdiction to entertain any application because the charge before it involves murder.

In the application, advocate Kibatala said the lower court has power to investigate the age of the accused according to section 113 of the Child Act.

“But the High Court, seeing that the lower court cannot make an investigation, should do so to satisfy itself that the accused is a child,” said Kibatala.

For their part, prosecution led by State Attorney Shadrack Kimaro asked the court to dismiss the application for lack of merit.Kimaro said that the law cited by the defence counsel in the application does not give authority to High Court to give the order.

According to Kimaro, the defence is required to appeal or seek review on the lower court’s decision instead of filing the application.But if they decided to file the application they should cite a section of the law that gives the High Court authority to give the order.

The Kisutu Resident Magistrate’s Court adjourned a murder case facing local film actress Elizabeth Michael alias Lulu to June 18, this year.Lulu is charged with murdering local movie star Steven Kanumba on April 7, this year, at Sinza Vatican. The case was yesterday brought before Resident Magistrate Augustina Mmbando for mention, with the prosecution informing the court that investigations were still going on.“The case is before the court today for mention because the investigations are not complete,” said State Attorney Peter Sekwao. Sekwao asked the court to set another date for mentioning the case and magistrate Mmbado adjourned it to June 18, this year.While the case continues at the Kisutu Court, the High Court will on June 11 this year rule on an application by the accused seeking the court’s order to determine her age.Advocate Peter Kibatala filed the application after a lower court turned down their request to transfer the case to a juvenile court. Lulu who was charged with his murder is now three months pregnant. According to Tanzanian tabloids, Lulu, 17, is reportedly carrying the late actor's baby. She has however not commented on the pregnancy. Lulu is rumoured to have  previously dated Tanzanian Ali Kiba. They remained friends after they broke up. Kanumba’s  sudden death devastated his fans from both within and outside the country. According to the police, Kanumba and Lulu were fighting over calls that were coming on her phone while she was at his home. He demanded to see the calls and the girl wasn't ready to surrender it. While he was taking it by force, she pushed him and he fell, hitting his head hard. She is still in police custody as the investigations are still underway.

Habari zinasema kuwa Kanumba alikuwa anajiandaa kutoka na mpenzi wake usiku wa kuamkia leo, alipokuwa bafuni anaoga akamsikia Lulu akiongea kwenye simu na mwanaume mwingine. Alipotoka bafuni kumwuliza kuhusu simu, Lulu alimsukuma kwenye ukuta, Kanumba kaanguka kufa pao hapo!  Ina maana kuwa kifo cha Kanumba umesabishwa na 'Domestic Violence'!
